Key Facts About Data Access

  • No warrant required - Any of these organizations can search Grafton's data without probable cause or judicial oversight
  • No notification - Grafton residents are never told when their data is accessed or by whom
  • Permanent storage - While Grafton deletes its own data after 30 days, any agency can download and keep what it finds indefinitely
  • Out-of-state reach - Agencies in states you have never visited can search your Grafton movements

Federal Agencies Are on the List

Grafton Police told a records requester in November 2025 that federal agencies do not have direct access, and that the department was "not aware" whether federal agencies had reached Grafton data through the network. The department's own transparency portal now lists six federal entities among the organizations granted access to Grafton's data:

  • Federal Bureau of Investigation (FBI)
  • Indiana HIDTA (High Intensity Drug Trafficking Area)
  • Midwest HIDTA
  • U.S. Postal Inspection Service
  • Wright-Patterson Air Force Base, Ohio
  • Indiana Dunes National Park

U.S. Immigration and Customs Enforcement (ICE) does not appear on Grafton's published list. Grafton's stated policy also prohibits use of ALPR data for immigration enforcement.

Private Companies Are in the Network Too

The organizations sharing camera data with Grafton Police include three private entities rather than law enforcement agencies:

  • Grafton Commons (WI) - the local retail development
  • Blain's Farm and Fleet (WI)
  • Home Depot Corporation

This confirms that privately owned cameras feed into the same system Grafton Police search, and that at least one national retailer contributes plate data to the network Grafton draws on.

A Note on Data Quality

Flock's published lists contain entries the company itself has marked as disabled, duplicated, or created for demonstrations, including "Cedarburg WI PD [Inactive]," "(Dead/Old) Plymouth IN PD," "Highland PD IN - DO NOT USE - DUPLICATE," "Deactivated Users," and two Flock demo accounts. These are shown in muted text above and are reproduced exactly as published. That a nationwide surveillance network's own access list is maintained this loosely is itself worth noting.

Why This Matters: This isn't just about Grafton police accessing camera data in their own jurisdiction. This is about more than a thousand organizations across the country, including federal agencies and private companies, with the ability to track Grafton residents' daily movements without any local oversight or accountability.
